Terms: By requesting a sample of the above-identified material (“Sample”) from NXTLEVVEL Biochem BV. (“NLB”), the below-identified entity (“Requestor”) agrees as follows: (1) Requestor agrees not to sell or provide the Sample to any other person or entity; (2) Requestor agrees that any Sample NLB provides pursuant to this request is provided without any guarantees or warranties, either express or implied; and (3) Requestor agrees that NLB, in providing a Sample to Requestor pursuant to this request, disclaims any implied warranties concerning merchantability, fitness for a particular use, and noninfringement of third-party intellectual property rights. (4) Requestor shall not directly or indirectly, acquire or appropriate any right to or interest in the Sample and shall not file any patent, utility model or design application based upon the Sample. In making this request and agreeing to these Terms, the person making the request has the authority to agree to these Terms on behalf of the identified entity.
